1. Agreement to Terms
These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and NovaSystems LLC (“Company”, “we”, “us”, or “our”), concerning your access to and use of the tmallcreator.com website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Site” and the "Service"). You agree that by accessing the Service, you have read, understood, and agree to be bound by all of these Terms of Service.
2. Description of Service
NovaSystems LLC provides a Software-as-a-Service (SaaS) platform for email verification, designed to integrate with SendGrid and other platforms ("Service"). The Service allows users to upload email lists and/or use an API to verify the validity and deliverability of email addresses. The Service is provided on an "as is" and "as available" basis.
3. User Accounts and Responsibilities
To access certain features of the Service, you may be required to create an account. You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. You are responsible for the data you upload to the Service and must ensure you have the legal right to process that data.
4. Prohibited Activities
You may not access or use the Service for any purpose other than that for which we make the Service available. As a user of the Service, you agree not to:
- Use the Service to send spam or unsolicited emails.
- Upload data for which you do not have the necessary rights or permissions.
- Attempt to reverse engineer, decompile, or otherwise discover the source code of the Service.
- Use the Service in any way that could damage, disable, overburden, or impair our servers or networks.
- Violate any applicable local, state, national, or international law or regulation.
5. Intellectual Property Rights
The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of NovaSystems LLC and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks may not be used in connection with any product or service without the prior written consent of NovaSystems LLC.
6. Termination
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.
7. Disclaimer of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. NovaSystems LLC makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, NovaSystems LLC does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.
8. Limitation of Liability
In no event shall NovaSystems LLC, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.
9. Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
10. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
